Protection of personal data according to the LOPD

“El Guadarnés”, in application of the current regulations on personal data protection, informs that the personal data collected through the forms on the website: “https://elguadarnes.es”, are included in the specific automated files of users of the product sales services.

The automated collection and processing of personal data aims to maintain the commercial relationship and to perform information, training, advice, and other activities typical of “El Guadarnés”.

This data will only be transferred to those entities that are necessary solely for the purpose of fulfilling the previously stated objective.

Data retention in accordance with the LSSI

“El Guadarnés” informs that, as a data hosting service provider and under the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the moment when the service provision began. The retention of this data does not affect the secrecy of communications and can only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to judges and/or courts or the Ministry that requires it.

The communication of data to the State Security Forces will be made in accordance with the provisions of the regulations on personal data protection.

Intellectual property rights of “El Guadarnés”

“El Guadarnés” holds all copyright, intellectual, industrial property, "know-how" rights, and any other rights related to the contents of the website “https://elguadarnes.es” and the services offered therein, as well as the necessary programs for their implementation and related information, unless otherwise indicated.

Reproduction, publication, and/or non-strictly private use of the contents, in whole or in part, of the website “https://elguadarnes.es” is not permitted without prior written consent.

Protection of hosted information

“El Guadarnés” makes backup copies of the contents hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the complete restoration of data deleted by users, as the aforementioned data may have been deleted and/or modified during the time elapsed since the last backup.

The services offered, except for specific backup services, do not include the restoration of contents preserved in the backups made by “El Guadarnés”, when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always prior to the user's acceptance.

The restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to “El Guadarnés”.

Commercial communications

In application of the LSSI. “El Guadarnés” will not send advertising or promotional communications by email or any other equivalent electronic communication medium that have not previously been requested or expressly authorized by the recipients thereof.

In the case of users with whom there is a prior contractual relationship, “El Guadarnés” is authorized to send commercial communications regarding products or services from “El Guadarnés” that are similar to those that were initially contracted with the client.

In any case, the user, after proving their identity, may request that no further commercial information be sent to them through Customer Service channels.
